Legislation was passed in June this year that introduces new anti-bullying measures that take place from 1 January 2014. The changes include the provision that if an employee believes a bullying claim is not being dealt with appropriately by the employer, they can go directly to the Fair Work Commission (FWC) for assistance with the claim. There is also the option to by-pass an internal claim altogether and go directly to the FWC without consulting the organisation.
It’s important that businesses have a comprehensive grievance procedure for bullying in place to ensure complaints are dealt with appropriately. If employees believe their complaint is being dealt with appropriately, they are less likely to go directly to the Fair Work Commission.
